Terms & Conditions For Clients
Welcome to CapySwim! We are committed to creating a fun, structured, and safe learning environment for all swimmers. Please read through the following Terms & Conditions carefully. By enrolling and making payment, you agree to adhere to the policies outlined below.
1. Class
- Late Policy:
Lessons start and end on time.
If a student is late, the class will still end at the original time.
If the coach is late, the missed time will be compensated.
- Attendence policy:
Please note that absences, tardiness, and last-minute cancellations (without valid reason) will not be eligible for refunds or make-up lessons.
Students missing four (4) or more consecutive lessons without valid reason may have their slot reassigned. Clients will be notified in advance.
Parents/Students are required to inform CapySwim via WhatsApp (98853116) if student will be absent for an extended period.
- Wet Weather Policy:
Light Rain (≤2.5mm/h): Lessons will proceed as scheduled in the pool if conditions are safe and the pool remains open.
Heavy Rain (>2.5mm/h) or Lightning Alert: Pool lessons cannot proceed during heavy rain or when a lightning warning is in effect.
If the coach has already arrived at the venue but the lesson is unable to commence due to weather conditions, the lesson will not be considered conducted. A make-up lesson will be arranged on a mutually agreed date.
Rain After Lesson Has Started:
If the lesson has already commenced and coaching has been conducted, the lesson will be considered completed.
If the lesson is interrupted due to weather, the coach will conduct dry-land training where feasible.
If dry-land training is not possible, missed time may be incorporated into a future scheduled lesson through an extension of lesson duration where appropriate.
- Group Lessons policy
CapySwim reserves the right to:
Postpone the class start date if minimum class size is not met.
Merge classes of similar levels if necessary.
Increase the number of students in a class if needed.
Group classes will proceed as scheduled, even if one or more students are absent, No Make up class for absentees.
If group lesson proceeds without absentees, the absent students will be charged:
50% of the class fee if a valid medical certificate (MC) is submitted.
50% of the class fee for female students aged 10 and above may use 1 menstrual leave per calendar month, without requiring a medical certificate (MC).
100% of the class fee if no valid medical certificate (MC) is submitted or the student has already used their monthly menstrual leave entitlement.
We seek your understanding that this charge covers the coach's reserved time and your place in the class, while helping to ensure the continuity and progress of group lessons for all students.
If all students are unable to attend and notify the coach at least 2 hours before the lesson, the lesson will be rescheduled as a make-up lesson at no charge.
- Class Cancellation & Make-Up Policy
Coach & Clients must provide at least 2 hours' notice to cancel or reschedule a lesson.
Client cancellations made with less than 2 hours' notice, no-shows, or when the coach is already en route or has arrived, will be fully chargeable and are not eligible for a make-up lesson.
Cancellations made with at least 2 hours' notice by either party are eligible for one of the following, subject to availability:
A make-up lesson;
An extension of a future lesson; or
A replacement coach (if the original coach is unavailable).
Make-up lessons are strictly for replacing missed lessons and cannot be used in place of the current term's scheduled lessons. They may be conducted on another day or by extending the term until all scheduled lessons are completed.
Make-up lessons must be scheduled and completed within 6 months from the original lesson date, failing which they will be forfeited.
Unless otherwise informed by CapySwim, both the coach and client are required to attend the scheduled lesson. Do not assume a lesson is cancelled due to weather or other circumstances without official confirmation.
- Trial Lesson policy
Trial lessons are chargeable and shall be considered a single 30 or 45-minute session (depending on age).
If the trial class cannot start due to wet weather or pool closure, no trial fee will be deducted. The trial may be rescheduled to another date with the full trial duration.
If the trial class has already started but is interrupted due to wet weather or pool closure, the remaining class time may be rescheduled to another date. The class will continue from the remaining time only and will not receive a new full 45mins-duration session.
If there are 15 minutes or less remaining in the trial session, the remaining time cannot be rescheduled. The students may choose to purchase another trial session or enroll in the 4-lesson package to continue their lessons, remaining time will extend in the lessons.
In the event the student is late or unable to attend the scheduled session, no make-up, replacement, or refund shall be provided.
- Lesson Slot Reservation & Temporary Break Policy
1. Slot Confirmation
All lesson slots are confirmed and secured only upon full payment is made. Each payment includes a 30-day slot reservation period starting from the date of payment.
2. Temporary Break
Students who wish to take a temporary break must inform the school at least 2 weeks in advance. To retain their existing slot during the break period, payment for a minimum of 4 lessons is required. If no payment is made, the slot may be released.
3. Extension of Slot Reservation
If lessons do not resume within the 30-day reservation period, an additional payment of at least 4 lessons is required to extend the slot for another 30 days from the new payment date. All extension payments will be treated as lesson credit for future use.
4. Slot Release
Failure to make the required extension payment, or discontinuation of lessons without proper notice or arrangement, will result in the automatic release of the reserved slot. The original timing will no longer be guaranteed and will be subject to availability upon return.
5. Non-Refundable Policy
All payments made for slot reservation or extension are strictly non-refundable, as the lesson slot is reserved exclusively for the student during the holding period.
2. Responsibility & Liability
We shall not be held liable for any claims arising from injury, damage, or loss of life that may occur while attending our swimming lessons. This includes any associated costs incurred as a result of such claims. It is further clarified that client shall be responsible for payment of any deposits, one-time payments, or monthly fees required by the condominium's Management Corporation Strata Title (MCST).
3. Fees & Commitment
Fees paid to CapySwim are strictly non-refundable.
Fees for 1 term of lessons (4 lessons) are billed in advanced before every start of new term lessons.
Fees payment constitutes acceptance of all policies in these Terms and Conditions.
CapySwim reserves the right to amend the Terms & Conditions
Full payment for all lessons, including trial classes, must be made within three (3) days from confirmation. Lesson slots will only be secured upon receipt of full payment.
Failure to make payment within the stipulated time frame will result in the lesson slot not being guaranteed.
The school reserves the right to deny participation to any student who arrives for a lesson without prior payment, especially in the event that the class has reached full capacity.
4. Private Arrangements & Engagement
Capyswim’s Participants/Students/Clients are not allowed to engage CapySwim coaches for private lessons outside the current arrangement.
5. Media, Data & Condo Arrangements
By providing your contact details or attending our classes, you consent to CapySwim and its partners collecting and using your contact information, as well as photos and videos taken during lessons, for administrative and promotional purposes.
CapySwim shall be responsible for all fees, deposits, and access arrangements only in respect of locations provided or managed by CapySwim.
For swim classes conducted at private condominiums not provided by CapySwim, clients shall be solely responsible for coordinating any and all arrangements with the respective Management Corporation Strata Title (MCST).
In instances where the client neither owns nor resides at the condominium, the client must ensure that a resident host (such as a friend or family member) is notified and assumes responsibility for granting access to the premises.
CapySwim will provide all necessary supporting documents (e.g., coach name, NRIC) upon request to help facilitate MCST approval.
6. Conduct & Discipline
All swimmers are expected to demonstrate respectful and appropriate behavior during lessons.
CapySwim reserves the right to discontinue lessons for any student whose behavior is disruptive, unsafe, or inappropriate.
7. Termination
You must give us at least 1 month (30 days) notice before stopping lessons.
Any break period during which lessons are not attended and payment is not made will not be counted towards the required one-month notice period.
Any unused make-up lessons must be used up before your lessons officially end.
8. Acknowledgement
By enrolling in CapySwim classes and completing payment, you acknowledge that you have read, understood, and agreed to the Terms & Conditions outlined above.
