Terms & Conditions For Clients
Welcome to CapySwim! We are committed to creating a fun, structured, and safe learning environment for all swimmers. Please read through the following Terms & Conditions carefully. By enrolling and making payment, you agree to adhere to the policies outlined below.
1. Class
Late Policy: Lessons start and end on time.
If a student is late, the class will still end at the original time.
If the coach is late, the missed time will be compensated.
Attendence policy:
Please note that absences, tardiness, and last-minute cancellations (without valid reason) will not be eligible for refunds or make-up lessons.
Students missing four (4) or more consecutive lessons without valid reason may have their slot reassigned. Clients will be notified in advance.
Parents are encouraged to inform CapySwim via WhatsApp (98853116) if their child will be absent for an extended period.
Wet Weather Policy:
Light rain (≤2.5mm/h): lesson proceeds in pool.
Heavy rain (>2.5mm/h) or lightning: pool lesson cannot proceed.
If class is interrupted, the coach will conduct dry-land training where feasible. Otherwise, make up options will be considered
Group Lessons
CapySwim reserves the right to:
Postpone the class start date if minimum class size is not met.
Merge classes of similar levels if necessary.
Increase the number of students in a class if needed.
If all students in the group cancel at least 2 hours before the lesson. In such cases, make-up lessons will be provided.
If only one or some students are absent/late from a group class, the lesson will continue as scheduled and lesson fee will still be chargeable. No make-up, refund, or credit will be provided for individual absences.
Trial Lesson
Trial lessons are chargeable and shall be considered a single 30 or 45-minute session (depending on age).
In the event the lesson is interrupted due to weather conditions or any other circumstances that prevent the lesson from being conducted (excluding situations where either the client or coach is unable to attend), and less than 30 minutes of the session has been completed, clients may opt to attend a second trial session of 30 minutes at a reduced rate.
Any unused time from the first trial session may be carried forward and added to the second 30-minute trial session, where applicable.
If the lesson is interrupted again after the second trial session, no further make-up, replacement, or extension shall be provided.
If 30 minutes or more of the trial session has been conducted, the trial shall be deemed completed in full.
In the event the student is late or unable to attend the scheduled session, no make-up, replacement, or refund shall be provided.
Any remaining unused time may only be carried forward upon purchase of a 4-lesson package.
Lesson Slot Reservation & Temporary Break Policy
1. Slot Confirmation
All lesson slots are confirmed and secured only upon payment of a minimum 4-lesson package. Each payment includes a 30-day slot reservation period starting from the date of payment.
2. Temporary Break
Students who wish to take a temporary break must inform the school at least 2 weeks in advance. To retain their existing slot during the break period, payment for a minimum of 4 lessons is required. If no payment is made, the slot may be released.
3. Extension of Slot Reservation
If lessons do not resume within the 30-day reservation period, an additional payment of at least 4 lessons is required to extend the slot for another 30 days from the new payment date. All extension payments will be treated as lesson credit for future use.
4. Slot Release
Failure to make the required extension payment, or discontinuation of lessons without proper notice or arrangement, will result in the automatic release of the reserved slot. The original timing will no longer be guaranteed and will be subject to availability upon return.
5. Non-Refundable Policy
All payments made for slot reservation or extension are strictly non-refundable, as the lesson slot is reserved exclusively for the student during the holding period.
2. Responsibility & Liability
All Capyswim Management and Coaches prioritizes safety and will take all reasonable precautions during lessons. However, coaches is not liable for injuries or damages occurring outside of lesson times or due to circumstances beyond our control.
Students should inform their coach of any health issues or concerns before class to help ensure safety.
3. Class Cancellation
Minimum two (2) hours’ notice required for cancellations, except under the Wet Weather Policy or any other circumstances that prevent the lesson from being conducted .
Cancellations within two (2) hours or no-shows are fully chargeable with no make-up.
If the coach is en route or has arrived, the session is considered consumed.
CapySwim may cancel lessons due to illness, weather, or safety concerns, with at least two (2) hours’ notice where possible.
4. Make up policies
a. Client or Coach Late Cancellation (Less than 2 Hours’ Notice):
The Coach may offer to extend future lessons to compensate for the missed time.
If the Client prefers not to extend future lessons, the missed session will be considered forfeited and will not be eligible for make up lesson.
b. Advance Cancellation (At least 2 Hours’ Notice by Either Party):
one of the following options will apply:
The lesson will be converted to a make up lesson.
The coach may offer to extend future lessons to compensate for the missed session.
If the coach cancels, CapySwim can arrange a replacement coach to takeover the lesson. (subject to availability)
C. Additional Notes:
Make-up lessons are strictly to replace missed sessions and cannot be used to replace current term's scheduled lessons.
Make-up lessons can be scheduled on a different day or on the regular class day/time by extending the term to ensure all 4 lessons are completed, provided it does not interfere with the current term’s scheduled lessons.
Both coach and client must still turn up unless officially informed otherwise. Do not assume cancellations due to weather or other factors without confirmation.
if the Coach is unable to do a make up lesson, CapySwim will arrange a replacement coach.
Make-up lessons must be arranged and completed within 1 year from the date of cancellation. Lessons not scheduled within this period will be considered forfeited.
5. Fees & Commitment
Fees paid to CapySwim are strictly non-refundable.
Fees for 1 term of lessons (4 lessons) are billed in advanced before every start of new term lessons.
Fees payment constitutes acceptance of all policies in these Terms and Conditions.
CapySwim reserves the right to amend the Terms & Conditions
Full payment for all lessons, including trial classes, must be made within three (3) days from confirmation. Lesson slots will only be secured upon receipt of full payment.
Failure to make payment within the stipulated time frame will result in the lesson slot not being guaranteed.
The school reserves the right to deny participation to any student who arrives for a lesson without prior payment, especially in the event that the class has reached full capacity.
6. Private Arrangements & Engagement
Capyswim’s Participants/Students/Clients are not allowed to engage CapySwim coaches for private lessons outside the current arrangement.
7. Media, Data & Condo Arrangements
By providing your contact details or attending our classes, you consent to CapySwim and its partners collecting and using your contact information, as well as photos and videos taken during lessons, for administrative and promotional purposes.
CapySwim shall be responsible for all fees, deposits, and access arrangements only in respect of locations provided or managed by CapySwim.
For swim classes conducted at private condominiums not provided by CapySwim, clients shall be solely responsible for coordinating any and all arrangements with the respective Management Corporation Strata Title (MCST).
In instances where the client neither owns nor resides at the condominium, the client must ensure that a resident host (such as a friend or family member) is notified and assumes responsibility for granting access to the premises.
CapySwim will provide all necessary supporting documents (e.g., coach name, NRIC) upon request to help facilitate MCST approval.
9. Conduct & Discipline
All swimmers are expected to demonstrate respectful and appropriate behavior during lessons.
CapySwim reserves the right to discontinue lessons for any student whose behavior is disruptive, unsafe, or inappropriate.
10. Termination
You must give us at least 1 month (30 days) notice before stopping lessons.
Any break period during which lessons are not attended and payment is not made will not be counted towards the required one-month notice period.
Any unused make-up lessons must be used up before your lessons officially end.
11. Acknowledgement
By enrolling in CapySwim classes and completing payment, you acknowledge that you have read, understood, and agreed to the Terms & Conditions outlined above.
